A MURDER COMMITTED BY A GROUP OF PERSONS, GROUP OF PERSONS BY PREVIOUS CONCERT

Abstract

The paper considers the errors committed by law enforcement officials while qualifying
the murders committed by a group of persons, group of persons by previous concert.
The Supreme Court of the Russian Federation, changing sentences due to incorrect application
of the criminal law, annually gives the explanation how these criminal acts should be
qualified. However, in practice mistakes are often committed due to an incorrect understanding
of the penal law relative to: (1) murder committed by a group of persons; 2) murder
committed by a group by previous concert; 3) actions directly intended to deprivation of
life of the victim.
