LEGAL BASIS FOR THE ACTIVITIES OF ADMINISTRATIVE COMMISSIONS OF MUNICIPALITIES OF THE CHELYABINSK REGION

Abstract

The features of the legal basis of the activity of administrative commissions of some
municipalities of the Chelyabinsk region are investigated.

It is revealed that the legislation of the Chelyabinsk region does not establish uniform
rules for the creation and regulation of the activities of administrative commissions of municipalities operating in the region. This legal gap leads to different approaches in the adoption of
title documents for the formation of administrative commissions in different municipalities.
The authors conclude that in the absence of legal regulation at the federal level on the creation
of administrative commissions provided for by the Administrative Code of the Russian Federation, it is necessary in the legislation of the subject of the Russian Federation to pay special attention to the adoption of clear rules regarding the regulation of the creation of administrative
commissions by municipalities. It is advisable to establish uniform requirements: the adoption
of regulations on administrative commissions of municipalities should be the competence of
exclusively representative bodies of municipalities, the formation of the composition of administrative commissions should be transferred to the competence of municipal administrations.
This will establish a uniform classical division of legislative and executive functions of local
self-government bodies of the Chelyabinsk region. It is necessary to formulate specific requirements for persons included in the administrative commissions of municipalities, specifying, among other things, the conditions for prohibiting the inclusion of a person in the commission. The article concludes that it is necessary at the legislative level of the Chelyabinsk region
to adopt a Model provision on the administrative commission of the municipality of the Chelyabinsk region in order to unify the organizational and legal work on the creation of such
commissions at sites.
