Abstract

The article reveals the features of the collection of traces, the knowledge of their forensic properties and the emergence of evidence in the process of investigation and disclosure of
criminal cases. The recognition of the existence of an important stage, the collection of traces (evidence) - the stage of cognition, the study of objects discovered during the production of investigative
actions, is justified. The process of evidence formation is shown as a result of the investigator's mental activity associated with the extraction of information from the traces - carriers of this information.
The theoretical and practical significance of the difference of concepts is indicated: collecting traces
and forming evidence.
