THE RATIO OF THE CONCEPTS "WORK SECRET", "KNOW-HOW" AND "INFORMATION WHICH IS THE TRADE SECRET"

The article is devoted to clarification of a ratio of such terms of intellectual
rights as "work secret", "know-how", "trade secret" "information
which is a trade secret". The solution of the problem of a ratio of the specified
concepts presents the correct idea of a ratio of legal phenomena given.
Analyzing the provisions of the Civil Code of the Russian Federation the
author comes to the conclusion that the terms "work secret" and "knowhow"
are identical in the legislation of the Russian Federation, and correspond
to the concept of "information which is a trade secret" as a type and a
sort.
