EASTERN AND WESTERN LEGAL TRADITION OF JUSTICE: GENESIS

The article is devoted to the problem of the Genesis of understanding the category of
justice in Eastern and Western philosophic and legal traditions. The author argues that in
modern world justice is represented as a fundamental scientific problem, philosophical and
legal value. Under conditions of globalization actual scientific problem is the study of characteristics
of understanding of justice in different cultures. In the article the authors conclude
about the differences in understanding and interpretation of the concept of "justice” in
traditional and post-traditional societies. The reasons that led to differences between eastern
and western ways of development of state and law, largely explain these differences. In the
early stages of development of society, the world seems to be a syncretic unity, containing
both natural processes and relations between people. There is no clear distinction between
the world of nature, living and inanimate, and the world of a man. This approach is reflected
in mythology of ancient Greek, and ancient east civilizations. If for the eastern civilization,
the difference between written laws and justice, however, does not imply the presence
of sharp differences between them, in the teachings of the ancient Greek philosophers these
categories are sharply contrasted.
