Abstract

The article deals with the issue of procedural features of the announcement by the
court of appeal of the testimony of witnesses obtained during the trial in a criminal case in the court
of first instance in the light of the existing legislative gap. The purpose of the study is to develop
theoretical provisions and recommendations of a law enforcement nature aimed at clarifying the
procedure for announcing the testimony of a witness within the framework of an appeal review,
previously received by the court of first instance. Based on the analysis of the existing criminal procedural legislation, the article proposes the author's recommendations on the rules for the announcement of testimony by the court of appeal.
