Abstract

The article is devoted to the analysis of problems associated with the conclusion of a management contract for an apartment building. Whole methods of concluding a contract are considered from the point of view of the effectiveness of legal regulation and the correctness of the application of legislative provisions.

A number of significant shortcomings of pronounced practical significance are identified. Some of them are compensated by judicial practice, which, however, is not uniform, and in some cases, seems objectionable. As the research showed, the elimination of the identified shortcomings is possible only by amending the current legislation. In this regard, the authors propose a number of recommendations for improving normative regulation.
