WITHDRAWAL OF LANDS FOR STATE AND MUNICIPAL NEEDS IN AN EXTRAORDINARY ORDER: PROBLEMS OF BALANCE OF INTERESTS AND PREVENTION OF CONSUMER EXTREMISM

Abstract


The article analyzes the problems of coordination of public and private interests in
withdrawing land for state or municipal needs in an extraordinary order on the example
of the legislation on organization and holding of the XXII Winter Olympic Games and
XI Winter Paralympic Games of 2014 in Sochi. The article examines the main provisions
of the procedure of withdrawal of land in preparation for the Winter Olympic Games of
2014 in comparison with the conventional (ordinary) order of withdrawal of lands and
real estate for public needs. It shows the most dispute-wide regulations designed to ensure
the organization and holding of sports events of the world level in a short time, and
law problems coming through their implementation. Legislation on the preparation for
the Winter Olympics of 2014 was the subject of research as the most striking example of
the extraordinary procedure of withdrawal of land for public needs of the modern period.
It addresses the issue of correlation of legal categories of the "balance of interests", "protection
of rights and interests," "consumer extremism" in relation to the study area.
