PROBLEMS OF GUARANTEES AND COMPENSATIONS FOR WORK IN HARMFUL LABOUR CONDITIONS IN THE TRANSITION PERIOD

Abstract


The article deals with the problem of providing guarantees and compensation for
work in harmful conditions in the transition period for the replacement of a January 1,
2014 certification of workplaces on a specific assessment of working conditions.
Simultaneously with the introduction of a special assessment had been made and the
amendments to the Labor Code, in particular the dependence of the size of the guarantees
granted to the employee and compensation to the degree of hazard. As a result, there was
a deterioration of the legal status of employees in comparison with the previously applicable
law. In order to maintain the previous volume guarantees and compensations legislator
provided for transitional provisions.
The analysis of judicial practice allows to draw conclusions about the existing problems
of the employees of the former volume guarantees and compensations while maintaining
appropriate working conditions in the workplace, which were the basis for their
appointment. Based on the analysis, the author proposes recommendations for changing
the existing legislation.
